Atoyan Associate sarkis.atoyan@aalrr.com 626-583-8600 April Szabo Associate april.szabo@aalrr.com 562-653-3200 03.31.2020 The President signed the Families First Coronavirus Response Act (FFCRA ) on March 18, 2020, which will take effect on April 1, 2020. The FFCRA created obligations for qualifying employers to provide temporary relief to eligible employees affected by the COVID-19 pandemic. Specifically, the Act: (1) requires certain employers to provide their employees with paid sick leave (a new benefit called Emergency Paid Sick Leave Act (EPSLA)); and (2) expands the Family and Medical Leave Act (FMLA) - the Emergency Family and Medical Leave Expansion Act (EFMLEA). Section 5103 of the EPSLA requires covered employers to post and keep posted, in conspicuous places on the premises of the employer where notices to employees are customarily posted, a notice, to be prepared or approved by the Secretary of Labor, of the requirements described in the Act On March 24, 2020, the Department of Labor (DOL) published a poster found here that will satisfy the above requirement. The poster defines which employees are eligible to receive paid sick leave, sets forth the qualifying reasons for leave and the entitlements covered employers must provide its employees. In addition, the DOL issued an FAQ on March 26, 2020, addressing questions with regard to the posting requirement for the new paid sick leave notice required by the Families First Coronavirus Response Act (FFCRA).
